Basic License (MP3)

Also known as non-exclusive rights. Purchasing a lease grants the Licensee (Customer) limited artistic and legislative rights to the corresponding beat(s) for one profitable or commercial use on any medium (i.e., album, EP, or mixtape) with a circulation of 2,000 sale units. If 2,000 sale units are reached and further sales are desired, the beat must be licensed again, as long as licensing rights are still available. A lease includes an untagged, high-quality MP3 file. A beat can be leased to more than one person simultaneously until the exclusive rights of the beat are purchased. Once the exclusive rights of a beat have been purchased, the beat will no longer be available for any leasing. Previous leasing rights that have been sold before are not affected and are still valid until the 2000 sale units’ cap has been reached. Leasing a beat does not make the Licensee the sole owner of the beat. With a leasing license, the Licensee is allowed to get profitable radio-, video- or television-airplay or to perform the song on commercial/profitable shows. Licensee cannot use any beat compositions as a background element in TV, Film & DVD/computer game projects without obtaining written consent & a separate license agreement. Licensee cannot sell, loan, rent, lease, or assign any of the products or corresponding rights to another person. Licensee agrees that Emlece Cypher maintains copyrights and ownership of the original instrumental composition. Licensee agrees to display the producer’s name (Emlece Cypher) in all physical media or within web presentation, i.e., CD’s, LP’s, digital downloads, etc. Leasing rights are subject to registrations in general terms and conditions, credit, payment, and delivery agreements.

Premium (WAV) and Platinum License (WAV + streams)

Same restrictions and conditions as in the Basic License with the following differences: A Premium License includes WAV files, while a Platinum license includes the tracked-out .WAV files and allows up to 10,000 sales units. Licensee (Customer) is allowed to alter or change audio tracks of the beat, as long as the beat maintains a recognizable product created by Emlece Cypher. Premium and Platinum leasing rights are subject to registrations in general terms and conditions, credit, payment, and delivery agreements.

Unlimited License Exclusive

The purchase of exclusive rights grants Licensee (Customer) full artistic and commercial rights to the purchased beats. There is no sales cap related to the exclusive rights. Exclusive rights include the tracked-out .WAV files of the beat. Previous leasing and premium license rights are not affected and remain valid until the sales caps are reached. Therefore, it is possible that the beat that has been sold exclusively has been licensed before. The beat will be marked as “SOLD” and will no longer be available for licensing or download. Licensee cannot sell any of the products sold or corresponding rights to another person. Licensee understands that Emlece Cypher maintains 100% copyright and ownership of the original instrumental composition. Licensee must include on all productions and products the producer’s name (Emlece Cypher). Licensee agrees to display the producer’s name in all physical media or within web presentation, i.e., CD’s, LP’s, digital downloads, etc. Exclusive rights are subject to registrations in general terms and conditions, credit, payment, and delivery agreements.

General Terms and Conditions

By accepting the terms and conditions, the Customer (also referred to as ‘Licensee’) declares that he or she is fully aware of all terms and conditions and agrees to and accepts them. Under no circumstances is a customer allowed to re-sell the beat in any form. Rights given to customers are not transferable in any case. Even if exclusive rights are sold to a beat, Emlece Cypher will be allowed to use the beat for promotional uses. Therefore, all beats sold exclusively will stay on the webpage. However, if exclusive rights are purchased, all licensing options to the beat will be removed, and the beat will be marked as “Sold Exclusively”. Customers may edit/alter the length of the beat as they see fit. Abuse or failure to adhere to listed terms and conditions will be punishable by law.
